Asbestos Victim Dies Just Before Winning Lawsuit - ReadNews
On First week June, a Manhattan jury returned a verdict in favor of the plaintiff, a victim of mesothelioma, who died just two months prior to hearing his victory. The former auto mechanic�s family was in attendance when the verdict was read.
According to court documents, Arthur H. Juni, Jr. worked as an auto mechanic for Ford Motor Company from 1965 and throughout most of his working years before retiring. Part of his duties included working with several car parts that contained an exorbitant amount of asbestos. Consequently, Juni was diagnosed with malignant mesothelioma in June of 2012. Shortly after, he filed a mesothelioma lawsuitagainst Ford, claiming that the company failed to advise him of the dangers of working around asbestos. Asbestos was used in gaskets, brakes, clutches, and other various car parts, and Juni was exposed on a daily basis to asbestos fibers for decades.
Juni�s first signs of health problems occurred in 2012 when he noticed chest pain and a cough that wouldn�t go away. He sought medical help, and in the summer of 2012, learned that he had malignant pleural mesothelioma, a life-threatening illness marked by cancer that invades the lining of the lungs. Shortly after diagnosis, Juni experienced a significant health decline, despite numerous treatments to help him manage the illness. There is currently no cure for pleural mesothelioma, but a combination of treatments, such as chemotherapy, medication, and surgery can help victims manage pain and prolong life expectancy.
After seeing how rapidly Juni�s health began to deteriorate, his attorneys made a video interview of his testimony in the event that he wouldn�t be able to attend the trial. Unfortunately, Juni passed away in March of 2012, just two months shy of the verdict. His video testimony, however, was presented to the jury, and was described as chilling and emotional.
On May 30, 2014, the jury returned the verdict in favor of Juni, awarding $11 million to his family. More than half of the compensation, $8 million, was to compensate for Juri�s pain and suffering. The remaining $3 million was awarded to Juni�s wife, Mary Jo Juni, for loss of consortium and loss of services.
According to Juni�s attorney, Ford tried every tactic to ensure that Juni didn�t win his lawsuit, yet their efforts were futile.
�Ford was a very tough defendant represented by very capable lawyers. But we were able to succeed by preparing ourselves extremely well for trial. We presented clear and compelling evidence and our law group exhaustively researched case-law to bolster our arguments,� Juni�s lawyer said.
